By granting that person a patent, the product creator usually has 20 years of exclusive rights to what he or she invented.Patents are important because they ensure that the money and time someone has spent to develop a new product for the progress of science and the good of mankind will potentially be able to be recouped. The patent itself describes the invention. It includes drawings and art. If you own a patent then everyone else is excluded from making, using, selling, or importing that product for as long as you hold the patent. The most common patents are for inventions, secrets, artistic expressions, and semiconductor designs.Patents are sometimes called intellectual property because they are the products of someone's mind. Once a patent for intellectual property is established the patent holder is entitled to the same kind of treatment as someone who owns tangible property. How Are Patents Created?Patents are created through a process called patent prosecution. The process determines whether
More >>

With the increase in intelligent and more radical approach to life a lot of people are turning their ideas into successful businesses. The process of inventing a product and its successful implementation is not as easy as it seems.Whenever a person gets an idea for an invention, the first step that needs to be taken is to apply for a patent for that particular product. Technically it is called as licensing patent rights but is more commonly known as licensing the invention. The inventor has the option of completing all the procedures himself or to take advantage of professional invention licensing companies. The inventor can license the patent right to a particular manufacturer and then collect royalty. The United States patent office grants thousands of patent licenses every year for different inventions. It is essential to consult an experienced lawyer before signing any license agreement. The license agreement includes provisions for upfront payments, royalty percentages and other infringement issues. Inventors can either give an exclusive license to a single party or a non-exclusive license to more than
More >>

Filing of patent in the inventors' own country and then filing through PCT route or filing directly through PCT route? This article takes you through some of the cases, which can decide on patentability strategies concerned with market potential.A patent is a territorial right or monopoly given by a state (authority) to an inventor against the complete disclosure of the invention. Patent grants the right to the inventor to prevent others from use, manufacture, and sale of the invention in that territory for a stipulated time period. It does not however include the right for the inventor themselves to practice the invention as this may be limited by legislation, regulations or the existence of another dominating patent.Whilst there is no such entity as a 'World Patent', it is possible to file a single international application thanks to the Patent Cooperation Treaty (PCT) which can then be used as the basis for patent applications in over 130 contracting states (including the European regional route). This is the reason why there are copyrights, patents and invention registration. So if you have an idea or an invention that you would like to claim ownership to, get a patent registration for it. You will not regret doing so. In fact, you may even regret it if you do not do something about it especially if your idea or your invention is worth it.If you plan to get a patent registration but you do not know where to start or how to go about it, there are a lot of websites that will give you the right information. You can even download some forms if you are seriously getting one. Once you submit your form to a patenting office, it will be accepted and assigned to a group to examine your invention. The patenting office has a lot of groups who specialize on a variety of things that makes them qualified to scrutinize your invention. Do you want to make money out of it or do you want others to know about your invention so they can benefit from it? You have to be clear on your goals because the answers will lead you to whether you are going to get a Statutory Invention Registration or a patent for your invention. There are some inventions and ideas that have not been patented and have been used for the greater good such as the biodiesel. Anybody can make a homemade biodiesel for fuel because somebody thought of it and filed for a statutory invention registration. Thus, people were informed of this fact and now everybody benefits from it.In just the same way, there are also some inventions that are tied with the inventor. Meaning, people will not be able to make use of the invention without the permission of the owner, unless of course, people have bought the product legally. This article will not cover the techniques in detail. There are multiple resources available online for each of the techniques mentioned in the article. Rather this article will show how to combine the techniques to produce a prototype and multiple copies. By using these techniques or variations, an inventor or entrepreneur would be able to make a prototype and multiple copies. In addition, by using the techniques I outlined in a previous article I wrote on low costs packaging and inventor or entrepreneur would be able to make a fairly complete product that could be test marketed or presented to a potential licensee.LimitationsFirst some warnings about the techniques outlined below. They are rather labor intensive. Not hard physical work per se, but it does require learning and developing new skills. Further, the number of copies that can be made using silicone molds varies and is dependent on the geometry of the components being molded. Typically the lifetime of a silicone mold More >>

But before we get into that, you need to understand how intellectual property rights work.Intellectual Property includes patents, trademarks, servicemarks, and copyrights.A) WHAT IS A PATENT?A patent allows you to exclude others from making or selling the invention but does not grant you the right to make or sell an invention. Generally, the term of a new patent is 20 years, and U.S. patent grants are only effective within the United States. There are three types of patents:1) Utility patents cover processes, machines, articles of manufacture, composition of matter, or any new and useful improvement of something.2) Design patents cover the design or look of an invention.3) Plant patents cover asexually reproduced distinct and new varieties of plants.A utility patent is the strongest patent an inventor can obtain to protect an idea and how it works.A design patent, although significantly less expensive, will only protect the way your invention looks (shape, color, size, etc), not the way and reason it works.B) WHAT IS A TRADEMARK OR More >>

Scientists investigate the world around us. They observe how things work and develop ideas about ways to make them work better. Sometimes they try to test an idea to explain how something works. Scientists perform experiments to find out how things work. The knowledge that they discover is useful for many things. It can help to build new machines. It can help scientists to develop new medicines or cure a disease. Technology is the use of scientific knowledge to create new things. Then what is an Inventor? An inventor is a person who creates a new idea or device to perform a task. An invention is the new technology created. An inventor with a new idea or design for an invention may decide to have the idea protected. The idea gets protection from the law in a paper called a patent. A patent prevents other people from making, using, or selling the new idea without permission from the inventor. Some inventions are simply a better way of doing or building something.
